Terms and Conditions for EMI Payments on Kingston Gate

Eligibility Criteria

  • Credit Approval: Tenants must pass a credit assessment conducted by our banking partner. Kingston Gate is a facilitator and does not provide credit.
  • Verification Documents: Tenants may have to provide necessary identification, proof of income, and rental agreement documents as required by the banking partner.

Payment Terms

  • Payment Schedule: EMI payments are to be made monthly as per the agreed schedule. Late payments may incur additional charges as outlined in the credit agreement with our banking partner.
  • Amount and Duration: The total amount (including deposits, first month's rent, and any additional expenses) is divided into equal monthly installments over the term approved by the banking partner.

Facilitation Role

  • Kingston Gate’s Role: Kingston Gate facilitates the transaction and does not handle or disburse credit. All credit decisions and approvals are managed by our banking partner.
  • Funds Transfer: Kingston Gate will transfer funds to the landlord only after all necessary due diligence has been completed and approved by the banking partner.

Landlord Payments

  • Payment to Landlords: Payments to landlords will be made directly by Kingston Gate upon receipt of the approved credit from the banking partner. Any disputes regarding the rental agreement must be resolved between the tenant and landlord.

Abuse and Misuse

  • Misuse of Service: Any attempt to misuse the EMI payment option, including falsification of documents or fraudulent activities, will result in immediate termination of the service and potential legal action.
  • Due Diligence: Kingston Gate reserves the right to conduct further due diligence to prevent fraud and abuse.

Customer Obligations

  • Accurate Information: Tenants must provide accurate and truthful information during the application process.
  • Compliance: Tenants must comply with the terms and conditions of both Kingston Gate and our banking partner.

Cancellation and Refunds

  • Cancellation: Once the EMI payment plan is approved and funds are transferred to the landlord, cancellation of the service is not permitted.
  • Refunds: In the event of a dispute that requires a refund, tenants must coordinate with their banking partner directly as Kingston Gate does not handle refunds.

Amendments

  • Terms Changes: Kingston Gate reserves the right to amend these terms and conditions at any time. Tenants will be notified of any changes, and continued use of the service will constitute acceptance of the new terms.

Liability

  • Limitation of Liability: Kingston Gate is not liable for any disputes between tenants and landlords or issues arising from the credit service provided by our banking partner.
  • Force Majeure: Kingston Gate shall not be liable for any delays or failures in service due to circumstances beyond our control, including but not limited to technical failures or banking partner issues.

Governing Law

  • Jurisdiction: These terms and conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms will be subject to the exclusive jurisdiction of the courts in Bangalore.
